La defensa consideraba que el trabajador lesionado ten\u00eda una discapacidad del 90% y que pod\u00eda trabajar. El perito vocacional de la defensa afirm\u00f3 que el trabajador lesionado pod\u00eda colocar baldosas y trabajar como guardia de seguridad. El trabajador lesionado presentaba una fractura de pelvis y tres discos fusionados en la zona lumbar.  Adem\u00e1s, camina con un bast\u00f3n. El tribunal se bas\u00f3 en el perito vocacional del Sr. More y determin\u00f3 que el trabajador no pod\u00eda ser reciclado y que era incapaz de competir en el mercado laboral abierto. Se orden\u00f3 a la compa\u00f1\u00eda de seguros de compensaci\u00f3n laboral pagar m\u00e1s de $100,000 en beneficios retroactivos, junto con la incapacidad permanente y el tratamiento m\u00e9dico en curso.
