Sufri\u00f3 lesiones graves en un accidente de tr\u00e1fico en el que solo se vio implicado un veh\u00edculo, ocurrido en la base a\u00e9rea mientras se dirig\u00eda al trabajo en su propio autom\u00f3vil.<\/p>\n<p>Present\u00f3 una solicitud de prestaciones por accidente laboral. El juez de accidentes laborales aprob\u00f3 la solicitud y emiti\u00f3 un dictamen en el que desestimaba la solicitud de reconsideraci\u00f3n presentada por el empleador.<\/p>\n<p>La Junta de Apelaciones de Indemnizaci\u00f3n Laboral revoc\u00f3 la decisi\u00f3n y dict\u00f3 una resoluci\u00f3n en la que denegaba las prestaciones al demandante, al considerar que las lesiones no eran indemnizables en virtud de la regla del trayecto de ida y vuelta.<\/p>\n<p>El Tribunal de Apelaci\u00f3n del Segundo Distrito de Apelaci\u00f3n admiti\u00f3 la solicitud del demandante de que se revisara el caso.<\/p>\n<p>LA RESOLUCI\u00d3N DEL TRIBUNAL DE APELACI\u00d3N<\/p>\n<p>El tribunal de apelaci\u00f3n se\u00f1al\u00f3 que la \u2019regla del trayecto de ida y vuelta\u201c impide, por lo general, que un empleado tenga derecho a prestaciones por accidente laboral mientras se desplaza localmente hacia y desde el trabajo en un \u201dlugar de trabajo fijo\u201c durante un \u201dhorario fijo\u00bb. Sin embargo, el desarrollo normal de la actividad laboral de un empleado comienza una vez que este ingresa al lugar de trabajo del empleador. En ese momento, seg\u00fan el tribunal, se aplica la \u00abregla de la l\u00ednea de demarcaci\u00f3n\u00bb y la \u00abregla del trayecto de ida y vuelta\u00bb deja de ser aplicable.<\/p>\n<p>El tribunal determin\u00f3 que en este caso se aplicaba la regla de los l\u00edmites de las instalaciones. El demandante era un empleado civil que trabajaba en una base militar que, por lo general, no estaba abierta al p\u00fablico.
