{"id":477,"date":"2017-06-10T12:06:54","date_gmt":"2017-06-10T12:06:54","guid":{"rendered":"http:\/\/bmcontent.dev\/bentley-more-llp-files-bad-faith-lawsuit-to-collect-67m-judgment"},"modified":"2025-10-08T08:43:19","modified_gmt":"2025-10-08T15:43:19","slug":"bentley-more-llp-presenta-una-demanda-por-mala-fe-para-cobrar-una-sentencia-de-67-millones","status":"publish","type":"post","link":"https:\/\/www.bentleymore.com\/es\/blog\/bentley-more-llp-files-bad-faith-lawsuit-to-collect-67m-judgment\/","title":{"rendered":"Bentley &amp; More LLP presenta una demanda por mala fe para cobrar la sentencia $67M."},"content":{"rendered":"<div class=\"featured-image\"><img decoding=\"async\" src=\"\/wp-content\/uploads\/2017\/06\/lsraynq437.jpg\" \/><\/div>\n<p>SAN DIEGO, 9 de junio de 2017 \/PRNewswire\/ \u2014\u00a0<a>Bentley &amp; More LLP<\/a>, junto con Berman &amp; Riedel, LLP, present\u00f3 una demanda por un siniestro de seguro <a>mala fe<\/a> demanda ante el Tribunal Superior de San Diego, en la que se alega que Preferred Contractors Insurance Company RRG se neg\u00f3 a llegar a un acuerdo sobre las reclamaciones presentadas contra el asegurado de PCIC, Online Builders, abandon\u00f3 a su asegurado justo antes del juicio y no se present\u00f3 a un arbitraje programado, lo que dio lugar a una sentencia por un monto superior a $67 millones.<\/p>\n<p>La demanda inicial, H\u00e9ctor Mede y otros contra WRKB Builders Inc., que opera bajo el nombre comercial de Online Builders, se present\u00f3 en abril de 2015 y alegaba que, en septiembre de 2014, H\u00e9ctor Mede sufri\u00f3 una lesi\u00f3n personal grave mientras trabajaba en una obra en Escondido, California. Online Builders supervisaba la obra y era responsable de la seguridad en el lugar de trabajo. Parte del proyecto consist\u00eda en retirar equipos de climatizaci\u00f3n de una azotea, lo que dej\u00f3 agujeros que Online Builders prometi\u00f3 proteger. Como resultado de su ca\u00edda, el Sr. Mede sufri\u00f3 lo siguiente:<\/p>\n<ul>\n<li>Lesi\u00f3n cerebral traum\u00e1tica;<\/li>\n<li>Lesi\u00f3n cerebral isqu\u00e9mica (accidentes cerebrovasculares) como consecuencia secundaria de su disecci\u00f3n de la arteria car\u00f3tida;<\/li>\n<li>Lesiones del nervio \u00f3ptico en ambos ojos;<\/li>\n<li>Otras lesiones graves en m\u00faltiples \u00f3rganos y lesiones ortop\u00e9dicas; y<\/li>\n<li>Un gran n\u00famero de lesiones adicionales, como la tetraplejia esp\u00e1stica y at\u00e1xica, la disartria esp\u00e1stica, la ceguera, el dolor cr\u00f3nico, los trastornos neurog\u00e9nicos del intestino y la vejiga, y los problemas cr\u00f3nicos de sue\u00f1o y emocionales.<\/li>\n<\/ul>\n<p>\u201cDe conformidad con la ley California, PCIC ten\u00eda la obligaci\u00f3n de proteger a Online Builders y de resolver las reclamaciones presentadas contra su asegurado siempre que fuera posible\u201d, afirm\u00f3 el abogado\u00a0<a>Gregory L. Bentley<\/a>\u00a0de <a>Bentley &amp; More LLP<\/a>. \u201cA pesar de haber tenido numerosas oportunidades para hacerlo, abandonaron a su asegurado, dejando a Online Builders con una sentencia de enorme cuant\u00eda y privando al Sr. Mede de la justicia que tanto se merece\u201d.\u201d<\/p>\n<p>Cuando se present\u00f3 la demanda inicial, Online Builders estaba asegurada mediante una p\u00f3liza de responsabilidad civil general comercial del programa Contractor Platinum, emitida por Preferred Contractors Insurance Company Risk Retention Group, LLC. Los demandantes alegan que las lesiones del Sr. Mede est\u00e1n cubiertas por las disposiciones b\u00e1sicas de la p\u00f3liza de PCIC, y en la demanda inicial, el abogado del Sr. Mede ofreci\u00f3 llegar a un acuerdo por el l\u00edmite de la p\u00f3liza en m\u00faltiples ocasiones. Estas ofertas estuvieron vigentes durante m\u00e1s de siete meses y expiraron el 2 de marzo de 2016. Para esa fecha, se hab\u00eda completado la presentaci\u00f3n de pruebas, se hab\u00eda tomado declaraci\u00f3n a los testigos y PCIC ten\u00eda acceso a los extensos registros m\u00e9dicos del Sr. Mede, que mostraban claramente que ya hab\u00eda pagado m\u00e1s de $1.5 millones en gastos m\u00e9dicos, y que hab\u00eda sufrido una p\u00e9rdida de ingresos y costos m\u00e9dicos futuros por m\u00e1s de $13 millones, as\u00ed como otros da\u00f1os a considerar. A pesar de los hechos de que dispon\u00eda, PCIC dej\u00f3 que la demanda prescribiera y luego retir\u00f3 la defensa que hab\u00eda estado proporcionando, abandonando pr\u00e1cticamente a Online Builders apenas dos meses antes del juicio.<\/p>\n<p>A ra\u00edz de la conducta de PCIC, los demandantes y Online Builders se sometieron a un arbitraje vinculante ante un \u00e1rbitro designado por el Tribunal Superior para resolver todas las cuestiones con arreglo al art\u00edculo 638 del C\u00f3digo de Procedimiento Civil de California.
