La mujer cruzaba cerca de la manzana 30600, al sur de Nyes Place, cuando fue atropellada por veh\u00edculos que circulaban en direcci\u00f3n sur. Este suceso forma parte de una serie de preocupantes muertes de peatones, accidentes y accidentes evitados por poco a lo largo de la PCH en los \u00faltimos a\u00f1os. Bentley &amp; More cuenta con d\u00e9cadas de experiencia en litigios relacionados con \u201ccondiciones peligrosas\u201d en bienes p\u00fablicos contra entidades como Caltrans, cuando su prolongado descuido de las carreteras peligrosas provoca incidentes que causan lesiones al p\u00fablico. Concretamente, en virtud del art\u00edculo 835 del C\u00f3digo de Gobierno de California, una entidad p\u00fablica puede ser considerada responsable <em>directamente <\/em>responsable de las condiciones peligrosas que entra\u00f1an un riesgo sustancial de lesiones cuando se utilizan con el debido cuidado y de una manera razonablemente previsible, siempre que dicha condici\u00f3n haya sido la causa inmediata de la lesi\u00f3n, haya creado un riesgo razonablemente previsible del tipo de lesi\u00f3n sufrida y haya sido creada por la entidad p\u00fablica o esta tuviera conocimiento real o impl\u00edcito de la misma. Para que prospere una demanda por condiciones peligrosas en bienes p\u00fablicos, deben cumplirse todos y cada uno de estos requisitos previos.<\/p>\n<p>&nbsp;<\/p>\n<p>En lo que respecta a la PCH, basta con una b\u00fasqueda superficial para encontrar una carretera de alta velocidad con <em>largo <\/em>tramos sin suficientes cruces peatonales, sem\u00e1foros, se\u00f1alizaci\u00f3n, alumbrado, marcas viales y otros dispositivos y se\u00f1ales para proteger a los peatones y a los conductores. Los peatones se ven obligados habitualmente a cruzar sin la protecci\u00f3n necesaria, una carencia de la que Caltrans es consciente desde hace tiempo y que no ha subsanado. Y, lamentablemente, los accidentes de peatones y los sustos han llegado a ser demasiado comunes en los \u00faltimos a\u00f1os, lo que ha provocado una oleada de muertes evitables, entre ellas <strong><em>dos <\/em><\/strong>en las \u00faltimas dos semanas.<\/p>\n<p>&nbsp;<\/p>\n<p>Bentley &amp; More LLP se suma al creciente coro de voces que instan a Caltrans a convertir la autopista South Coast en una v\u00eda m\u00e1s segura y adecuada, capaz de proteger mejor al p\u00fablico.
