When someone dies because of another person’s carelessness, the family left behind often has more than one legal option. A wrongful death lawsuit compensates the people who loved the person who died. A survival action lets that person’s estate collect much of what they could have claimed had they lived.
A California wrongful death attorney can help determine which claim fits a specific situation. Our abogados especializados en lesiones personales en Bentley & More LLP handles both types of claims for families across Orange County and the rest of California.
Puntos clave
- A wrongful death claim belongs to surviving family members, not the estate.
- A survival action lets the estate pursue what the decedent could have claimed while alive.
- Both claims can often be filed together, but each runs on its own deadline.
What Does a Wrongful Death Lawsuit Cover in California?
A wrongful death lawsuit, filed under Código de Procedimiento Civil de California, § 377.60, belongs to the close family of the person who died, not the estate. Spouses, domestic partners, children, and sometimes parents or other dependents can bring this claim for their own losses. Losses may include lost financial support, lost household services, funeral costs, and loss of the relationship itself. Fatal incidents frequently stem from high-speed motor vehicle collisions, where driver negligence cuts short a victim’s life.
What Does a Survival Action Let the Estate Recover?
Bajo Cal. Civ. Proc. Code § 377.30, a claim the decedent could have brought while alive passes to the estate instead of disappearing at death. Survival actions are limited to economic losses, such as medical bills and lost wages, plus punitive damages when warranted.
How the Two Claims Compare Side by Side
- A wrongful death claim pays the surviving family for their own losses.
- A survival action pays the estate for the decedent’s own economic losses before death.
- Only a survival action can carry punitive damages against a reckless wrongdoer.
- Filing both together, where facts support it, usually lets a family pursue the full range of compensation available. If the fatal crash involved a commercial vehicle or an on-duty vehículo de transporte compartido, corporate liability insurance policies may apply to both actions.
What Deadlines Apply, and Does a Government Agency Change Things?
A wrongful death lawsuit must generally be filed within two years of death under Código de Procedimiento Civil de California, § 335.1. A survival action follows the decedent’s original deadline or six months after death, whichever is later, under Cal. Civ. Proc. Code § 366.1.
When a city, county, or agency like Caltrans caused the injury, a shorter deadline applies. California’s Government Claims Act requires written notice within six months.
Preguntas frecuentes
Who receives the money from a wrongful death settlement in California?
The money goes directly to the eligible survivors, such as a spouse, domestic partner, or children, rather than passing through the estate.
Does a survival action cover the decedent’s pain and suffering?
Not for actions filed now. Senate Bill 447 window applied to actions filed on or after January 1, 2022 and before January 1, 2026 and was not extended. So, survival actions filed on or after January 1, 2026 do not include pain and suffering.
What happens if a government agency is responsible for the death?
A claim against a city, county, or state agency carries a strict six-month notice deadline. Missing it generally bars the claim entirely.
